When someone dies, if you are named as an Executor of a Will you will need to apply for a Grant of Probate.
This is an official document which you will need to administer the deceased’s estate. We can take that burden away from you and can offer you sensitive, practical support you need to make things stress-free at this tough time.
Probate is the process of dealing with the estate of someone who has died, including distributing their money, assets and possessions in accordance with their Will, after paying any taxes and debts.
If you need to administer an estate, you will need to apply for the right to do so, either with a grant of probate (if you are named as an executor in the Will) or Letters of Administration (if there is no Will). If you are an executor there are specific rules that set out how they should notify the authorities and distribute the estate. You will be responsible for numerous duties, including having the estate valued, selling the deceased’s home, paying Inheritance Tax where owed and distributing any bequests within the Will and the process can be further complicated if there are any disputes e.g. between beneficiaries or the tax man.
You may just need a little assistance with the administrative aspects or calculating the right amount of Inheritance Tax that is owed. We can help you ensure that your duties as an Executor are carried out properly and not exposing you to any legal risks.
Or, may want an experienced probate lawyer to take over the complex and time consuming probate process for you and this can then allow you to concentrate on grieving and supporting your loved ones with complete reassurance that all aspects of probate will be dealt with properly and you then have absolute peace of mind. Our Probate solicitors can help you with the task of getting probate, dealing with the assets of the estate and ensure that the wishes of the deceased are carried out.
Whatever help and support you need, our considerate, highly experienced probate solicitors are here for you.
